Temporary resident permit is a document that will allow you to enter Canada despite your inadmissiblity. It is issued for a certain period of time, upon request, and you must demonstrate a compelling need to enter Canada. This could be for business or to visit your family or friends. The TRP does not overcome your inadmissilibty.

You may quaify for a permanent criminal rehabilitation provided that a prescribed period of time has lapsed since the completion of your sentence. This will depend on the type of offence committed outside Canada. An approval of your criminal rehabilitation application means that you are no longer inadmissible to Canada.

The criminal rehabilitation application is submitted at a Canadian visa office in the USA. Processing times are between 9-12 months. If you need to enter Canada sooner, you could also apply for a temporary resident permit at the Canadian visa office abroad. You may apply for both a temporary resident permit and criminal rehabilittation at the same time, since the first is a temporary and the second is a permanent solution.


You first need to determine if you are inadmissible to Canada. If you were denied entry to Canada, you are most likely inadmissible. You will need to obtain your FBI report and your court records. They will indicate the nature of the offence. Then the offence in the USA will need to be compared to the equivalent offence in Canada. The purpose of this is to determine the waiting period before you can apply for criminal rehabilition to Canada. This could be 5 or 10 years.

Once you have established that you qualify to submit the application, you will need to complete the application forms published on the IRCC website, and provide the required supporting documentation. Then you will need to mail the application to the Canadian visa office in Los Angeles, CA, or in New York, NY. This will depend on your current state of residence in the USA.

If your application is completed with the required forms, signed and dated correctly, and complete supporting documentation, the visa office will send you communication with your file number and a client ID number.

For your application to be approved, you will need to establish that you are now of good character. Documents that help with this are proof of stable employment and residence, proof of volunteer work and community ties, supporting letters from friends and family, and documents indicating a compelling reason for you to be allowed to enter Canada.

If your offence was committed in Canada, you will need to obtain a Record Suspension, rather than Criminal Rehabilitation.
